Overhanging hedges can become a legal issue if they obstruct public pavements. Local authorities may require them to be cut back to keep footpaths safe and accessible (Highways Act 1980).
- A letter has arrived from the council about your hedge
- People are stepping into the road to get past it
- It is covering a street sign, a lamp post or the view at a junction
- You would rather sort it before anyone complains

What the law says
Section 154 of the Highways Act 1980 lets a council require the owner of a hedge or tree to cut it back where it overhangs a road or footpath and gets in the way. If the owner does nothing, the council can do the work itself and send the bill.
The date on the letter
A notice gives a deadline. Tell us what it is when you get in touch, and send a photo of the hedge.
Nesting birds still count
An active nest is protected, notice or no notice. If birds are nesting in the hedge, speak to the council before any cutting is done.

How far back does the hedge have to go?
Back to your boundary, so the whole width of the footpath is clear, and high enough for people to walk underneath. The notice from the council gives the detail.
Can you do it before the deadline?
Tell us the date on the notice when you get in touch and we will say straight away whether we can meet it.
Do you take the cuttings away?
Yes. Everything that comes off the hedge leaves with us.
